1. General conditions
These conditions of sale are intended to define the contractual relations between C&O Distribution and the purchaser and the conditions applicable to all purchases made through the internet site, www.bazarsuisse.ch. All orders placed on the site, www.bazarsuisse.ch, imply an acceptance without reserve by the purchaser of these conditions of sale. All purchases made through the internet site, www.bazarsuisse.ch, are subject to these general conditions of sale. These apply to merchandise that the purchaser orders via www.bazarsuisse.ch on the internet. These conditions of sale have precedence over all other general or particular conditions not expressly accepted by www.bazarsuisse.ch.
www.bazarsuisse.ch reserves the right to change its conditions of sale at any time. In such a case, the applicable conditions will be those in effect on the date on which the purchaser placed his/her order.
2. Data Protection
The personal data that you transmit to us are recorded only in the files of www.bazarsuisse.ch. These data will be used to process your order and to organize promotions, for example via email.
The addresses will not be communicated or transmitted to third parties. The personal data of purchasers will be used only within the framework defined by the federal law on data protection.
3. Prices
The prices of the merchandise appearing on the website www.bazarsuisse.ch, are net prices in Swiss francs (CHF), in euros (EUR) or in US dollars (USD). The prices in effect are those published on the website, www.bazarsuisse.ch.
For all orders sent out of Switzerland, customs duties and taxes might be charged to the customer.
The customer is responsible for all procedures necessary for the importation of goods into his territory in accordance with the law in his country.
www.bazarsuisse.ch reserves the right to change its prices at any time, it is however understood that the price appearing on the site on the date of the order will be the only applicable price for the purchaser.
4. Orders
Orders are placed online using the internet order page on the basis of the items listed on the bazarsuisse shop.
Purchasers who wish to place an order must:
1) Identify themselves with a valid postal address
2) Fill out the registration form, giving all information required;
3) Accept these conditions
4) Confirm their order and its payment
5) Make the payment in accordance with the stated conditions.
All data supplied and the recorded confirmation constitute proof of signature and acceptance of the transactions made.
www.bazarsuisse.ch will send an email order confirmation of the recorded order.
5. Conditions of payment via internet
All payments must be made via Paypal, credit card, E-banking (bank) or E-finance (post office). Please check our "secure payment" section for all details.
6. Shipping conditions
Packages are generally shipped all over the world within 10 days after receipt of payment. All deliveries are carried out by the Swiss postal service.
Standard shipping is via SwissPost, delivered against signature.
Particular care is taken with shipments containing fragile items.
Items are packaged in oversized cartons and well protected.
The availability of items on our website is updated constantly, but there might be one or the other items selected which is unavailable. In this case, we will inform you of this situation by e-mail within 48 hours.
7. Shipping costs
Shipping charges include packing, handling and postage. We encourage you to group your purchases in a single order because we cannot group two separate orders. For orders shipped to foreign countries, a separate shipping charge will be applied to each order.
8. Exchanges and returns
No exchange, return or reimbursement is possible, except in cases of serious damage. Serious damages are considered to be damages that render the item useless. In this case, getting in touch with www.bazarsuisse.ch is obligatory.
9. Responsibility
www.bazarsuisse.ch promises to put in place all means at its disposal to ensure the best possible quality of service. However, www.bazarsuisse.ch cannot be held responsible for malfunctions occurring on the internet and electrical networks.
10. Cancellation and force majeure
Force majeure is defined as any unforeseen outside event beyond our control, which prevents us from performing our normal services. In cases of force majeure generally recognized as such by jurisprudence, the obligations relating to the order in progress will be suspended for the duration of the event. If the force majeure lasts more than 30 consecutive days, the order in progress will be cancelled. In addition, www.bazarsuisse.ch reserves the right to cancel any contract at any time, without stating cause. In this case, www.bazarsuisse.ch promises to reimburse the purchaser.
11. Applicable Law and jurisdiction
These general sales conditions are subject to Swiss law, no matter what the country of the purchaser.
Any dispute relating to the interpretation of our orders or relating to the execution of our services, which cannot be resolved by amicable means, shall be decided definitively by the competent tribunals of the canton of Vaud.
The cancellation of one or several clauses of these general sales conditions does not void the entire document.
In case of a legal vacuum, the provisions of the Swiss Code of Obligations are alone applicable. Any dispute is subject exclusively to Swiss law. The place of jurisdiction is Lausanne.
